Short description of the contract or purchase(s): The Winfrith site in Dorset is licensed under the Nuclear Installations Act and contains a range of redundant nuclear facilities that are entering a care and maintenance regime together with a number of administrative office blocks. The site currently has a working population of 200 people. UKAEA require the provision of a flexible on site emergency response service supporting UKAEA in its duty to provide comprehensive emergency planning and instant response in advance of the arrival of the statutory external emergency services. The contract will be for 24 months commencing 1.4.2008. The main duties of the response team are currently: first line fire fighting response; rescue of injured or trapped personnel; ambulance aid response; assistance to external emergency services; response service provided 24 hours a day every day of the year. Throughout the duration of the contract it is anticipated that the response team will provide other duties that may be determined by UKAEA in support of its activities across the Winfrith site. The service offered by the appointed contractor must be capable of adapting proactively to a change in workscope and the nature of activities provided under the contract. A staff of 21 from the present supplier currently provide the service. It is UKAEA’s opinion that the EC Acquired Rights Directive: Transfer of Undertakings (Protection of Employment) regulations (TUPE) applies. A station commander supervises 4 teams of 5 staff trained as fire fighters first aid responders and in the use of confined space rescue techniques. UKAEA provides all site accommodation vehicles. PPE. RPE and equipment. A separate pre-qualification questionnaire will not be issued. A contractors conference will be held on 7.12.2007. An invitation to tender will be issued on 10.1.2008. Contractors will be required to formally confirm their intent to bid for the contract by close of play on 17.1.2008. Tenders will be due for return by 31.1.2008 (14:00). The contractors conference will present the current scope of the service and allow contractors to view the site at which the service is provided. Attendance at the conference is preferred but not mandatory. Technical capacity: Information and formalities necessary for evaluating if requirements are met: Those companies who request to participate must provide to the contract point (as listed in this notice) an expression of interest including the following information:commercial:1) company registration details postal and email address telephone and fax numbers.2) evidence of satisfactory economic and financial capacity including audited accounts for the last 3 years.3) evidence of current levels of insurance cover for contractors all risk employers liability public liability and professional indemnity including details of all insurance claims within the last 5 years (including outstanding claims). Technical:4) evidence in support of customers to whom similar services were or are provided during the previous 2 financial years including provision of certificates of satisfaction contact details and references.5) evidence of satisfactory understanding and experience of working a nuclear licensed site (or similarly highly regulated site).6) detailed evidence of current pension scheme and how a comparable pension (in accordance with HM Treasury guidelines) would be achieved for TUPE transferees7) details of industrial relations policy8) evidence to demonstrate record of previous successful TUPE Transfers and associated change management controls required. Details of TUPE transfers which have been completed must be provided with references.9) details of qualifications and relevant experience of key proposed staff for this contract in addition to the current staff of 21. Safety and Environment:10) provide copies of safety and environment policy statements and copies of relevant certification (e g. ISO14001. OSHAS 18001. ROSPA awards etc.).11) provide accident incident statistics for the last 3 financial years including for each year the average number of employees the number of RIDDOR accidents the number of RIDDOR Dangerous Occurrences the number of RIDDOR diseases the accident frequency rate and accident incident rate.12) provide details of enforcement actions and prosecutions for the last 5 years including details of improvement notices prohibition notices and prosecutions.13) evidence of satisfactory safety management understanding and experience including details of working under similar strictly controlled conditions and a summary of the safety arrangements relevant to this project. Quality assurance:14) provide details of quality assurance policies.15) evidence of quality management system certified to ISO 9001:2000 or equally appropriate quality managements including copies of certificates.

Maximum number: 8Objective criteria for choosing the limited number of candidates: Candidates will be assessed based on the information provided in Section III.2.3. If more than the required number of candidates meet the conditions for participation the qualified candidates will be ranked and the top ranked candidates will be invited to tender.

Lodging of appeals: Precise information on deadline(s) for lodging appeals: UKAEA will incorporate a minimum 10 calendar day standstill period at the point information on the award of the contract is communicated to tenderers. This period allows unsuccessful tenderers to seek further debriefing from the contracting authority before a contract is entered into. Applicants have 2 working days from the notification of the award decision to request additional debriefing and that information has to be provided a minimum of 3 working days before the expiry of the standstill period. Such additional information should be sought from the contracts officer named in this notice. If an appeal regarding the award of a contract has not been successfully resolved the Public Contracts Regulations 2006 No 5 which apply to England. Wales and Northern Ireland and the Public Contracts (Scotland) Regulations 2006 No 1 which apply to Scotland provide for aggrieved parties who have been harmed or are at risk of harm by a breach of the rules to take action in the sheriff court the Court of Session. (Scotland) or in England and Wales and Northern Ireland the High Court. Any such action must be brought promptly (generally within 3 months) Where a contract has not been entered into the Court may order the setting aside of the award decision or order the authority to amend any document and may award damages. If the contract has been entered into the Court may only award damages.
